Liability

The participants acknowledge that registering and participating in the Mountain Bike Training Program with MTB Academy may entail certain risks of physical injury, damage to property, and other damages or losses that the participants may sustain. The participants agree to voluntarily assume the full risk of any physical injury, as well as any and all other damages and losses to persons and property the participants may sustain. The participants hereby agree to waive and relinquish their right to file a lawsuit relating to injuries or damages of any kind whatsoever arising from or relating to your participation, and expressly release The Floating Pivot LLC, MTB Academy and any organizing party and its affiliates of any and all claims, causes of action, and rights at law or in equity arising from or relating to your participation.

Consent

The participants hereby consent the use of any footage taken during the activity for social media use or for the purpose of any commercial activities by MTB Academy managed by The Floating Pivot LLC

Booking

Sessions are non-refundable but are transferable if MTB Academy is notified more than 4 days prior to the booked date.

On rare occasions courses may be cancelled by MTB Academy if there is 3 or less clients booked. Should this occur, transfer to another course date or a full refund will be offered by Mtb Academy.

Equipment & Riding

Bikes, protective equipment, foods, fluids, are not provided by Mtb Academy. Each rider is expected to carry suitable food and hydration provisions for the session. Remember that riding and being active is thirsty work!

It’s compulsory to wear a certified cycling helmet throughout any Mtb Academy class. Additional body armor including eye-wear, gloves and knee pads are strongly recommended for intermediate courses and above. For Newbies and Beginners, we recommend clothing that is light and breathable, and not prone to tears and rips in case the rider comes in contact with thorns from trees or bushes, or falls on dirt.

The bike you use for your session should be in good working order. Mtb Academy reserves the right to cancel the session without a refund should our representative deem the rider’s bike unsafe for use.

Nature

Mountain Biking carries small risks which could result in personal injury. MTB Academy will endeavor to teach in safe areas and on suitable terrain however, the customer/ rider accepts that risk of injury is a part of mountain biking and has the option to withdraw from any activity at any point should they feel uncertain about proceeding.

Should the weather or ground conditions be deemed unsafe by the MTB Academy representative, an alternative date/ session will be offered to suit the customer. MTB Academy will make decisions on weather as early as possible, however this may be on the morning of the course or during a session.

MTB Academy reserves the right to stop any session without a refund should the MTB Academy representative deem the rider either dangerously unprepared or to have provided inaccurate information regarding their riding experience causing danger to themselves and others.

Should a session be cancelled or cut short due to weather conditions, an alternative date will be arranged at no extra cost to cover missed ground.
